Certification Declaration, Responsibility & Liability Framework
Ethical Mark™ operates as an independent certification and evaluation institution that provides a structured, methodology-based assessment of organizations’ alignment with ethical competition principles.
The certification system is fundamentally based on declarations submitted by applicant organizations. These declarations constitute the primary input for the evaluation process and are considered binding in terms of their accuracy, completeness, and authenticity as provided by the applicant.
Certification outcomes, including Bronze, Silver, and Gold classifications, reflect a time-bound assessment of the organization at the moment of evaluation and are issued for a defined validity period. Continuation of certification status beyond this period requires renewed assessment based on updated data and conditions.
It is expressly acknowledged that:
Certification is derived from submitted declarations and reflects the organizational status at the time of evaluation,
The responsibility for the accuracy, completeness, and ongoing validity of all submitted declarations lies entirely with the applicant organization,
Ethical Mark™ does not act as a regulatory authority and does not perform legal, statutory, or compliance audits,
Certification does not constitute a legal guarantee, regulatory approval, or continuous verification of conduct,
The sustainability of the certified status depends on the ongoing practices and compliance of the certified organization within the validity period,
Ethical Mark™ provides only a structured evaluation and classification framework based on declared information and defined methodological criteria.
To the maximum extent permitted by applicable law, Ethical Mark™ shall not be held liable for any direct or indirect damages arising from:
reliance on certification outcomes,
inaccuracies or misrepresentations in submitted data,
decisions made by third parties based on certification status,
or actions and conduct of certified organizations after certification issuance.
Ethical Mark™ further assumes no responsibility for the interpretation, representation, or misuse of certification results by certified entities or third parties.
This certification framework shall be understood as an independent, methodology-driven marking and evaluation system, designed to reflect declared organizational behavior within a defined validity period, rather than a continuous monitoring, enforcement, or guarantee mechanism.
